END-USER LICENSE AGREEMENT (EULA)


IMPORTANT READ CAREFULLY: This End-User License Agreement (EULA) is a legal agreement 
between you (either an individual or a single entity) and Michael D. Newby for the 
Recursive Creativity LLC products which may include online or electronic documentation 
("Software") provided with or in the Recursive Creativity LLC product you have downloaded 
or obtained by other means. By downloading, installing, copying, or otherwise using the 
Software you agree to be bound by the terms of this EULA. If you do not agree to the 
terms of this Agreement, you are not authorized to use Recursive Creativity LLC products 
distributed by Michael D. Newby.

The Software is protected by copyright laws and international copyright treaties, as well 
as other intellectual property laws and treaties. The Software is licensed, not sold.

1. GRANT OF LICENSE. 

Michael D. Newby per this EULA grants you the following rights: the right to use copies 
of the Software for any purpose other than presenting as your own work, for commercial 
gain or per restrictions below.

2. RESTRICTIONS. 

You must maintain all copyright notices on all copies of the Software. You may not reverse 
engineer, decompile, or disassemble the Software, except and only to the extent that such 
activity is expressly permitted by applicable law notwithstanding this limitation. 

3. TERMINATION.

Your rights under this EULA never terminate.

4. COPYRIGHT.

All title and copyrights in and to the Software and any copies thereof are owned by 
Michael D. Newby.....unless otherwise mentioned therein!

5. NO WARRANTY.

Any use of the Software is at your own risk. The Software is provided for use as Freeware 
for non-commercial uses. To the maximum extent permitted by applicable law, Michael D. Newby 
and any suppliers disclaim all warranties and conditions, either express or implied, 
including, but not limited to, implied warranties of merchantability, fitness for a 
particular purpose, and noninfringement.

6. NO LIABILITY FOR CONSEQUENTIAL DAMAGES. 

To the maximum extent permitted by applicable law, in no event shall Michael D. Newby or 
any suppliers be liable for any special, incidental, indirect, or consequential damages 
whatsoever (including, without limitation, damages for loss of business profits, business 
interruption, loss of business information, or any other pecuniary loss) arising out of 
the use of or inability to use the Software, even if Michael D. Newby has been advised 
of the possibility of such damages. Because some jurisdictions do not allow the exclusion 
or limitation of liability for consequential or incidental damages, the above limitation 
may not apply to you.
